There are other ways to protect the ebay community without forcing private auctions on those of us who don't want it, such as making it impossible for another ebayer to contact you outside of ebay, any contact should go into an ebay only email box on their site. Then you turn in the person if they send fake email,  that way unless the person has a business dealing, the link to try to get your private log in info becomes impossible to get. 

I don't know about any of you but even with the private bidder system, I am still getting the fake, try to get your log in info emails.  In fact I just got one yesterday for a shirt that I "won" that looks very official and it tells me to hit the log in button from the email to go to ebay, well I never bid on a shirt, the email was fake, they were wanting my password. Where did the protective private bidder system help in that matter?

This new system in creating distrust in the world of ebay, they are losing bidders/sellers to other sites, this is not about protecting sellers, this is about protecting money they make from shill bidders, because if the shill bidders bid up their item they make more money. If a seller wants a private auction they should get that option and if you are a bidder and you only want to bid on private auctions you had that option. They should allow those who don't want it to have that option too, thats the ebay I signed up for .

The thing is, this system is causing people to lose interest in ebay, the numbers are down, and as that happens and continues to happen it will kill ebay as we knew it. Look at Bid4bears it is a great site and the one thing that hurts it, is it hasn't built up the numbers to draw as much interest yet. But hopefully as more people get tired of ebay they will go check out that site and that will help it grow. Which I really hope it does.

Jeremy, I will go check it out, my camara for some reason has on every picture, a slight pink smudge, I have cleaned the lens, so it has to be in the camara, I have had it for a long time and I guess it's time to replace it, I just hate having to get used to something new. But your pictures are so nice it has motivated me.

Shane everytime I see that cover of yours , I smile, my youngest used to wear a hat just like that and he wore it backwards, if I can find it I'll post it to show you what I am talking about.

OK I have started a blog because my website completely sucks and the blog looks so much better, because they do all the work for you on layout which I am completely clueless on. Shelli, I wish I had just a smidge of your design ability.

Everyone is making some REALLY good points, from now, on all my auctions I will have a blurb about not wanting my work used in a collaboration . Because even though most people are honest and good , there are some really vile people that will use you anyway they can, to beneifit themselves and unless you know everything that person has done, it really opens you up to being lumped into their wrongdoings .

Isn't it really sad we have to worry about stuff like that.

Sue Ann, I can't believe that they used your bears on T-shirts without your knowledge. Wrong Wrong!!!!!

Shelli and Kim, thanks for all the great info, I guess what I need to do, is just list in my auction somewhere,
"that I would rather not have my work used in a collaboration, but resell is allowed".  And if someone does it anyway I guess I would need to weigh the cost of time and money against  the damage of my name.  I think anyone that has any integerity would respect that.

I guess as in my case the person had been caught shill bidding and I just did not want that connection, I didn't know she had been, so I was knocked for a loop when I found out she had, she seemed like a really nice person, I guess I just want to protect my good name and would rather no one promote my work but me.

I think as artists, we have to be able to control our creative product in some way, just not sure what is the way to do that..

I just went and googled something that may help us all here's what I found:

Section 102.
Subject Matter of Copyright: in general Section 302. Duration of copyright:
Works created on or after 1 Jan. 1978:
(a) Copyright protection subsists, in accordance with this title, in original works of authorship fixed in any tangible medium of expression, now know or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device. Works of authorship include the following categories:
(1) literary works
(2) musical works, including any accompanying words;
(3) dramatic works, including any accompanying music;
(4) pantomimes and choreographic works;
(5) pictorial, graphic, and sculptural works;
(6) motion pictures and other audiovisual works
(7) sound recordings; and
(8) architectural works.

(b) In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, illustrated, or embodied in such work.


Some simple things to remember -

1. Everything is copyrighted at the moment of its creation by the author or visual artist... they do not need to register the work in order to "own" its copyright.

2. Protect your own material - post notices (like the ones you will see on pages from which you found this page) on your Web site - if you REALLY want legal protection and think you might need it - register your works with the copyright office, but normally this is NOT a legal requirement - just makes it easier if you want to sue somebody for infringing your copyright.

3. If you find out someone is infringing (using without permission) - you must let them KNOW that they are using your material.

4. Understand what is and is not copyright material before you use it. If a website offers free graphics and marks them as "not copyrighted" - great! Have fun with them - but if an image is clearly marked as copyright material - don't use it unless you get permission!

You know it's funny, I sell so many bears to other countries and I think you have to, to be successful in this business, but it is getting so frustrating it will be hard to want to continue to do it.  It reminds me of that wonderful saying "If it ain't broke, don't fix it."

I know what you are saying about reselling the bear and the pictures are really bad, I have had the same thing happen, I don't mind that,  I cringe but I don't mind that. 
But is there a way to not have our name attached to someone that is not on the up and up, can you put in the description about not listing my name? Because when they do, it looks like it was a collaboration when it so wasn't. Can we protect out name as an artist?

I mean even ice cream bars or candy bars has it clearly on their boxes "Not for Re-sale" can't we too do the same on the issue of collaborations, I don't have a problem with the person reselling the item by itself, I just do not want to tie my name to an unknown reputation.

A few years back someone bought something I made and sold on ebay and after she paid for it she asked if she could include it in an auction she was going to list, I said sure that would be fine, I was new to ebay.  Well in about a week she did just that , then about 2 days go by and I get an email from another artist telling me this woman had been removed from ebay for shill bidding and why would I want to attach my reputation to hers.  Well I was so upset but my hands were tied I had to watch the auction finish out.

Needless to say I never let anyone I don't know super well use any of my work with theirs for all the world to see.

What's your thoughts on this, do you want your work resold then included in others auctions without your approval?

I am still waiting to hear from the Susan G. Komen people, so I am ready to go, but can't until we get that OK ed.
When the time comes when we do this and it  gets closer, I am going to put together a press release kit for everyone to use to contact their hometown paper to promote this event, if you would like. I think it would be a wonderful way to get the info out.  I am hoping that each paper will feature the artist that lives in the area, to get hometown interest generated for this important event

Patty, Don't you love the floaty pens, I think they are really cool, you know it's funny, I noticed something, a lot of us collect the same type things, which makes me think that because we are creative, we tend to go towards the same things. Which I really like, it makes me feel connected to a lot of you.
