Unfortunatley Trooper is the victim of an unpaying bidder, it was a new member with 0 feedback from India, they registered the day of the auction start, I gave them the benefit of the doubt, but now 7 days after the end of the auction I have still had no contact with the winner. I have also requested their contact information, but really don't want to have a long distance call to India on my phone bill.

my question is, do I file a non paying bidder claim and wait another 7 days, or offer Trooper to the second bidder with the second chance offer who is eager to buy him.

eBay isn't really clear on which way to go, I can't find any real guidelines, and it gives me the option of doing both....so just wondering do I forget about filing the claim and go right to second chance, or wait it out and possibly lose the second bidder if she has to wait too long to purchase him?

what would you do? I am leaning towards going right to the second chance.

doh.... i feel for you, im having a similar prob... id go with the 2nd chance bidder, they obviously have no regard for ebay or their feedback so you prob never will hear from them.

I agree.

In my listings I state that: contact needs to be made within 2 days and payment needs to be made within 5 days, unless other arrangements have been made. Did you make similar statements in your listing? If you did, then that's a contract...and the buyer broke that contract....which leaves you free to offer your wonderful dog to the next high bidder.

Thank you so much for your input everyone. I do have in my auction contact within three days and payment within 7, so I decided to go ahead with the second chance offer instead of filing a claim....not like they would do anything anyways! so why wait another week for nothing.

Right thing to do, you have to look out for yourself. Ebay is all about the buyers experience now, I have had four yes, I said Four zero feedback bidders since they changed their policy, Guess how many paid on the auctions, NONE!!!!!
Good for you, Your auction was wonderful and Trooper was a beautiful work of art!!

Check your bidding history.

If "Bidder A" won the auction but broke the contract, "Bidder B" should rightfully get the option to buy.

However, if "Bidder A" made an offer that exceeded "Bidder B's" PREVIOUS bid, the price will be inflated:

Bidder A:  $100.00 (Winning Bid)
Bidder B:  $95.00   (Second Chance)
Bidder A:  $90.00
Bidder B:  $85.00
etc...

Since "Bidder A" is out of the picture, should "Bidder B" have to pay $95.00 or $85.00?

US Bears, I could be talking outta my butt here, but I'm pretty certain that when you use eBay's "official" Second Chance Offer option, eBay does those calculations for you.  I've never used it myself, I admit.  But I do know that Second Chance Offers are supposed to be made exclusively through eBay, and I believe they originate from the non-pay listing itself.

I also know that, technically speaking, if you offer a listed eBay item to someone outside the confines of eBay, you're violating their TOS.

So I think the inflated price concerns are probably handled within the eBay system itself when the Second Chance Offer is made.  It's not left to the seller to determine the "correct" Second Chance price, I don't think.

I'd love confirmation on this, however.  Anybody know for certain??

You got it Shelli! I went through the official eBay second Chance offer (through Trooper's auction), and it automatically calculated the offer at the second highest bidders max bid. It shows up now for the 2nd high bidder as a buy it now exclusivley for them at their max bid.

Oh so its not just me then...I just posted a topic reading the same as yours Krista...why do people do this!!!!  I too have a second chance to fall back on, but I know the girl as a previous customer, so will offer it to her privately, fed up of ebay...but I was going to do the same thing, offer the bear at the bidders price before the bogus bid was place....sigh...good luck Krista, hugs!!  and you too Kim hugs! this stinks!

It's good to hear that eBay has a system in place for this.

We have bought things from eBay before but we have never sold anything.  Any items we have sold have always been by private deals.

I would do it straight away unpaid bidder dispute and I can guarantee they won't reply to it. I HAVE had 2 OF THEM THIS YEAR. New bidder no feedback reg the day of auction. Thats why i have a section in my postage sectiion about bidders under 10 feedback. If they bid I email them and if they don't respond to my email I withdrawn their bid and I have done so once or twice. On the other hand I did have a 0 feedback person bid and they did respond to my email and since then they have bough another bear. In my email I ask them to read my auction carefully and I would like to know there intention of payment. And I say if you do not answer this email I will withdraw your bid. This has seemed to work so far for me. But there are so many annoying people, that just love to stuff it up for others.

Another thing. I find this only happens to me when I list in feature plus. I still have the same amount of people looking at my auction and same results in  the end. So why am I paying for that extra???????? Good luck Krista

It happened on my auction for Little Kip...the bidder ran the price up to $2225 and then didn't pay. I checked out the address which didn't exist and then filed a complaint to ebay under ''False Contact Details' . Ebay then immediately struck off the person..whoever it was ...and I got my fees back. I then sold the bear privately to a collector.
I have literally no idea why this is done...maybe just out of malice ...or mischief..I dunno. There is talk of ''shield bidding' which in my case I don't think applied ...but at some stage this happens to many sellers and who knows why.

All I will say is that it has a negative affect because the '0' bidders are as much a worry to buyers as they are to sellers and the high prices that they falsely bid put people off bidding at all.
I set my bar very high after that and now no-one can  bid who is not a PayPal member...and while I ask zero bidders to get in touch before bidding under threat of cancelled bids I don't know how practical that will be ...but it's a warning shot.

It shouldn't have to be this way but unfortunately there are people out there which too much time on there hands.

Jenny you too!!!  Its so weird, I remember all these bears being bid on the same week that mine was listed......and Jenny, I google earth'd my bidders address, the suburb exists, but not the street!  I feel like such a fool that I waited a week without even looking into it!  I'm glad, but also not, that it hasn't just been me....since its my first time on feature etc, second time listing, its been like arghhh....noooo!!
Okay, so you got total fees back?  I got to read into this more, I didn't get total.....maybe I pressed the wrong button......I'd like the whole thing to go away and sell it privately too since I know the second bidder and not give Ebay any more of my money....
whats shield bidding?  I know shill is bidding on your own stuff right?  will have to look that up....
edited to add...Peta, good idea about taking away 0 feedback bidders if they don't respond..I didn't know how to work that one, and I worried I'd loose customers by not letting first timers bid......but the email idea is good...actually, now I think of it, my first bidder was a newbie too, and emailed me and asked permission...that worked smoothly and I asked her if she could pay right away etc...it wasn't hard to do....thanks for all these comments even tho this isn't my thread bear_original  I'm learning lots  bear_flower
