And that Mimzy mockup is... hmm. I wasn't even here for the Mimzy saga, but reading back I know how much effort had to be put in: at least it only made $22!

Eewwwie. Can she do that? Wouldn't Mimzy or her likeness be trademark protected? She did say Mimzy like but no.

Marlys.... no she can't do this legally, to my knowledge. But, at this very moment, I don't have the energy to fight it. Not that it's my fight.... it's New Line Cinema's fight.......... I'll report it...... not to ebay but to New Line... once I figure out who at New Line........

She had to have one of Tonner's Mimzies.... taken it apart... copied the pattern pieces (which I designed, mind you!)....  pathetic really, that someone would do something like this. She probably thought she'd get hundreds for it like I did for the ones I put on eBay which were authentic (made by Tonner Doll) and autographed by me. Even those being sold by others not autographed by anyone were going for up to $200. Supply and demand.....

This person has listed 3 on eBay so far.... two are current auctions. She's not even getting enough for them to cover her costs and time.

Daphne , Yours outshines it by about a billion times, I am so excited to get my Mimzy, have they came in yet? My youngest son is driving me nuts, he heard me ordering it and  almost every day he runs to the mail box.  He is so excited to get this.

Per Tonner in regards to the Collectible Mimzy:

Expected ship date: Summer 2007

That means it could be August for all I know! Sorry I don't have a better answer. I've given them my pattern and provided assistance in finding a source for her fur. The rest is up to them.... nothing to do with me.

Holy C- - - !!! I just looked back at the comments and saw this auction - THAT is MOST DEFINITELY Copyright Infringement!!!!

It's also in direct conflict with eBay's rules about NOT using a well-known name to hype one's own goods!
One cannot say - "Snoopy-like" dog. "Like Mimzy" is the same. Whether or not they go after this one small time (and horrible reproduction) seller is up to Tonner - they are  responsible for 'policing' their Mark - THK GD it's not you! - as going after infringers costs big bucks.

KNOCK OFF UPDATE: eBay removed one of her two current auctions. She apparently changed the title of her other current auction before they removed that one too. She can't do anything about changing/removing her closed auction so New Line and Tonner will see that one and the "similar to Mimzy" title. Likely won't care.... not worth going after her for $22 is it?

You never know Daphne.  Some of these big corporations like New Line like to put a stop to this sort of thing.  In the end, it sets an example for others NOT to imitate her....even if it was 'only $22.00'... she was most certainly infringing on rights.  And with as large reaching as Ebay is, that could be very damaging to the New Line Cinemas.  I rather hope they discuss it with their attorneys and 'sic 'em'  bear_grin

At least you're not the one having to bother one way or another, but her bunny wasn't anything as good as the REAL Mimsy  bear_wub  Not even close!

I kinda agree with DebbieD. A letter from their attorney would probably do it. She is infringing and if she continues, or others try the same thing, it could be more than $22 they're talking about. I just don't like people who don't play fair.

Daphne,  even though Tonner is a large company they very well may get in contact with this seller and advise her to stop what she is doing.  We know of a lady in Niagara Falls who does beautiful air brushing on clothing and she did a few a Disney shirts and Jean Jackets, not many mind you  and Disney somehow found and she was contacted by phone and in writing by Disney's lawyers advising her to stop immediatley or they would take her to court .

So you never know, big company or not they need to protect their copyright.

I've always wondered about artists that work for years putting out replicas; the Canadian comes to mind with Snoopy & Woodstock replicas.
When I had a custom knitting business I was continuously asked to knit team logos into everything imaginable - from face cloths to leg warmers to dog sweaters. Scary. I did look into things like the MLB & NFL: for a (football) Chicago Bears logo, it was something like $500,000 to purchase a license to drawn a pattern of the logo and then about $40,000 for each and every logo I designed into the scarf, sweater, hat, etc garment it would've been knit into.

My knit shop had another customer that was making nylon wind socks in the early 80s, long before the banners/wind sox/flags became so big. One of the places she'd put them was in a little gas station in downstate Illinois. Who knew? - a PR guy with the Chicago White Sox bought gas there..... and took down the info on the designer. She didn't receive a Cease & Desist letter from the Sox, but a "Show Us Your Books For The Last Five Years" demand.
Scary!!! 
Is it worth it? No. As artists, we've got too many good ideas in our own fertile imaginations to spend time copying someone else.

Wow, Bobbie! 5 years!

Even I'm not making Mimzy's for sale. Nor am I making any for anyone as gifts because I just know that SOMEONE will put it on eBay and make a small fortune and I'll be really, really ticked. Never mind New Line sueing my poor butt! There are 2 Mimzys out there that were not sent to New Line for the making of the movie that I made which I know my hubby nor my dad will be putting on eBay!

Artist have better things to do, very true! But crafters apparently do not. bear_sad

This "Kimzy" rabbit has indeed been reported to Tonner and New Line... what they do from there is up to them. I can see where, regardless of how isolated the incident or how little the person makes from the sale, that it would be in the best interest of New Line to put a stop to it.

If people cant do better than the original then why even bother.

unbelieveable the nerve some people have, by the way Daphne I saw today our in tv guide an article about Mimzy coming to the cinemas in Belgium with a great photo of Mimzy too bear_original  So Mimzy is now in Flemish bear_original
